Do I need a Gewerbe (trade registration) to sell on Etsy?

If you sell regularly with intent to profit, yes. The Finanzamt looks for three signals: repetition, profit intent, and a public market presence. Ten handmade candles a month is already enough. Registration happens at your local Gewerbeamt and costs a one-off 15–60 €.

Exception: if you only resell your own used goods (a one-off clear-out of vintage items from your basement, for example), you stay in the private sphere. Which taxes do Etsy sellers pay in 2026?

Three taxes matter for an Etsy shop:

  • Einkommensteuer (income tax) on profit (revenue minus deductible expenses). Reported via Anlage G and the EÜR (cash-basis P&L).
  • Umsatzsteuer (VAT): 19 % on sales to German consumers — 0 % under the small-business rule (§19 UStG, up to 25,000 € prior-year revenue and a 100,000 € current-year ceiling).
  • Gewerbesteuer (trade tax) kicks in above 24,500 € annual profit for sole proprietors (this is the allowance).

Sales to consumers in other EU countries fall under the OSS scheme above 10,000 € total annual EU revenue: you remit the foreign VAT centrally to the German Bundeszentralamt für Steuern instead of registering separately in France, Italy and so on. What does Etsy report to the German tax office (PStTG / DAC7)?

Since 2023, Etsy is legally required to report your sales data to the Bundeszentralamt für Steuern (BZSt) once you hit 30 or more transactions or more than 2,000 € in annual sales. The data is forwarded to your local Finanzamt automatically; you receive a copy of the report inside your Etsy account.

Do I need to register with LUCID (the packaging register)?

Yes, the moment you ship any packaged physical product. The duty applies from the first shipment — there is no minimum threshold. Two steps:

  • Register for free with the Stiftung Zentrale Stelle Verpackungsregister (LUCID) at verpackungsregister.org.
  • Buy a licence from a dual-system provider (e.g. Der Grüne Punkt, Interseroh). Pricing starts around 30 €/year for small volumes.

Ignoring the rule risks fines up to 200,000 € and a ban on selling. Etsy itself doesn't check your LUCID number — but the federal office does, and competitors or customers can report missing licences.

How do I invoice Etsy customers and book Etsy fees?

Invoicing duty: B2B sales always require a full invoice per §14 UStG. B2C sales need one from 250 € gross upward; below that the simplified Kleinbetragsrechnung is enough. Kleinunternehmer add the line „Gemäß §19 UStG wird keine Umsatzsteuer ausgewiesen“.

Yes — most German Etsy sellers do it part-time. Three things to check before you start:

  • Tell your employer: most employment contracts contain a notification clause. Explicit approval is only required if your Etsy shop directly competes with your employer's business.
  • Health insurance: as long as your day job remains dominant in both hours and income, you stay in statutory insurance without an extra contribution for the self-employed activity.
  • 48-hour cap: combined working time may not exceed an average of 48 hours per week (Arbeitszeitgesetz).

Returns, cancellations and cross-border sales — what to watch?

Returns: EU consumer law grants buyers a 14-day right of withdrawal. Once the item is back (or the buyer proves shipment), you must refund the full amount including the original outbound shipping cost. Etsy handles the payment automatically — in your bookkeeping you still need a credit note so your UStVA matches.

Cross-border sales:

  • B2C within the EU: German VAT up to 10,000 € total EU revenue; OSS scheme with each country's rate above that.
  • B2C outside the EU: 0 % VAT, but keep proof of export (e.g. DHL shipment confirmation).
  • B2B within the EU: reverse charge with the buyer's valid VAT ID (check it in the MIAS/VIES database first).
